RECORD OF PROCEEDINGS

AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-2012-01675

 COUNSEL: NONE

 HEARING DESIRED: NO

_________________________________________________________________

APPLICANT REQUESTS THAT:

His Fitness Assessment (FA) test score dated for 14 Mar 12, be
declared void and removed from his record.

_________________________________________________________________

APPLICANT CONTENDS THAT:

On 14 Mar 12, he was scheduled to take his FA test. His provider
neglected to sign his updated profile; therefore, the profile was
never entered into his records. He was required to perform all
components of the FA and was injured during the sit-up component
of the test. He was on a profile at the time and should not have
tested in certain components. He has since passed his FA with a
score of 94.

In support of his request, the applicant submits copies of his AF
Form 469, Duty Limiting Condition (DCL) Report; AF Form 422, Notification of Air Force Member’s Qualification Status; FA score
sheets and a letter with a medical profile from his physician.

The applicant’s complete submission, with attachments, is at
Exhibit A.

STATEMENT OF FACTS:

Information extracted from the Military Personnel Data System
(MilPDS) indicates the applicant is currently serving in the
grade of senior airman, having assumed that grade effective and
with a date of rank of 12 Apr 12.

The DLC report dated 19 Mar 12 (submitted by the applicant)
indicates he was undergoing a Medical Evaluation Board (MEB) to
determine medical fitness for continued worldwide duty and
retention. His AF Form 422, dated 22 Mar 12, indicate a
restriction of “Push-ups and sit-ups at own pace as tolerated;
run at own pace and distance as tolerated. …cleared to test on
the waist measurement and the 1 mile walk.”

_________________________________________________________________

AIR FORCE EVALUATION:

AFPC/DPSIM recommends disapproval of the applicant’s request to
void the FA score; however, they recommend the cardio, push-up
and sit-up components of the FA dated 14 Mar 12 be updated to
reflect “exempt” in the Air Force Fitness Management System
(AFFMS). DPSIM also recommends the applicant’s abdominal
circumference remain in the AFFMS. His overall composite score
will reflect 67.50 (unsatisfactory).

The complete DPSIM evaluation, with attachment, is at Exhibit B.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant
on 18 May 12, for review and comment within 30 days. As of this
date, this office has received no response (Exhibit C).

THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by existing
law or regulations.

2. The application was not timely filed; however it is in the
interest of justice to excuse the failure to timely file.

3. Sufficient relevant evidence has been presented to
demonstrate the existence of error and injustice to warrant a
measure of relief. While we note the applicant requests his
Fitness Assessment dated 14 Mar 12 be removed in its entirety
from his records, we find the evidence provided is insufficient
to recommend granting his request as stated. However, we are in
agreement with the recommendation of the Air Force office of
primary responsibility to exempt the cardio, push-up and sit-up
portions of his FA. We note the recommended relief will not
result in a satisfactory FA score since the applicant’s abdominal
circumference will remain in AAFMS. Nevertheless, based on the
evidence provided, we believe this constitutes the most
appropriate form of relief. Therefore, in view of the above,
we recommend the applicant’s records be corrected only to the
extent indicated below.

_________________________________________________________________

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force
relating to the APPLICANT, be corrected to show that the cardio,
push-up and sit-up components of his Fitness Assessment, dated
14 Mar 12, be updated to reflect “exempt” in the Air Force
Fitness Management System (AFFMS).

This logic also concludes a medical condition causing weight gain would cause an increase in AC. She should have never taken the walk test while her dosage was still being adjusted and the FA should be invalidated based on the solid medical evidence presented. While we note the applicant requests the entire FA dated 25 Apr 2012, be removed, the AF Form 422 reflected that she was cleared to test using AC and she has not provided substantial evidence to persuade us otherwise.
